US Patent Office Cancels Redskins Trademark

They aren't going to be able to hold onto the name. It's over for them. They need to just change their name to the Washington Patents or something. When that's over it will turn to the other teams like the Chiefs and Indians. PC trumps tradition. They are fighting up a greased hill at this point.

I'm a trademark attorney, so please let me know if you have any questions about the subject.

The long and short of this ruling is that the Skins no longer have a FEDERAL registration in the mark.  That means that the mark is no longer afforded the protections of the Lanham Act - the federal law governing trademark rights.   They can still use it, and assert common-law (state) rights.  Practically speaking, this won't have a huge impact on the franchise.  They will have a little more trouble policing the mark (i.e. suing counterfeiters), but it's not that big of a deal.  

That said, the TTAB ruling is certainly newsworthy and will put further pressure on the team to change the name.  The ruling legitimizes the fact that the name IS disparaging.  I'm glad it happened.

This is so stupid they should change the name to the Washington Morons and make a politician the new logo and mascot.

The African Lion isn't an American citizen, so I don't think they have a case against the pathetic Detroit Lions organization. It is a shame that our team makes that species look like newborn kittens.

Yes - I am actually. I am 1/8 Cree.  I am not offended at all by the Redskins name.  I also take offense to almost nothing. That is not the point. 

"Redskins" is disparaging.  Read the TTAB opinion and familiarize yourself with the relevant definition of "disparaging."  Feel free to submit an amicus brief in support of the appeal of the TTAB decision that is surely pending.

This is so stupid. I really don't feel anyone is that offended, but this is the day and age we live in so whatever. 

If they do end up having to change the name(which I don't believe they should), what do you guys think it should change to?

I'm thinking something along the line of the "Hogs". Has some history with the fan base so it might help with some of the transition.

Shouldn't you and I decide hat is offensive to us?
I don't see it as anymore disparaging than "red neck ". There 're tv shows galore about reflects.
Besides, the Redskins are paying tribute to our heritage by naming the team after us. Its a positive. They considered native Americans to be tough,strong warriors.
I consider the politicians pushing this agenda to be agents of division.

If two individuals in the patent office can unilaterally and capriciously withdraw trademark protection that has existed for years and upon which business decisions and investments have been made, then what is the point of trademark protection?

Think of how many millions of dollars in brand equity the government just destroyed without compensation. Not that I am wedded to the name Washington Redskins, but I really want the government brought to heel. They should have no right to withdraw a patent on a whim like that.

I think the name Redskins is pretty offensive, even if I'm not offended by it myself. Frankly, I'm surprised it's held up this long.
