Unlike other situations we've seen firsthand... Donna Shalala's initial response is strong. UM President Donna Shalala took issue with the NCAA’s investigation, alleging that the NCAA believed some of former booster Nevin Shapiro’s claims without corroboration from anyone else. While the university chose not to release a copy of the allegations because it is a private school and has the right to withhold the information, Shalala, who was courtside in the BankUnited Center on Tuesday night for a UM basketball game, released the following statement from the game: “The University of Miami deeply regrets and takes full responsibility for those NCAA violations that are based on fact and are corroborated by multiple individuals and/or documentation. We have already self-imposed a bowl ban for an unprecedented two-year period, forfeited the opportunity to participate in an ACC championship game, and withheld student-athletes from competition. “Over the two and a half years since the University of Miami first contacted the NCAA enforcement staff about allegations of rules violations, the NCAA interviewed dozens of witnesses, including current and former Miami employees and student-athletes, and received thousands of requested documents and emails from the University. “Yet despite our efforts to aid the investigation, the NCAA acknowledged on February 18, 2013 that it violated its own policies and procedures in an attempt to validate the allegations made by a convicted felon. Many of the allegations included in the Notice of Allegations remain unsubstantiated. “Now that the Notice of Allegations has been issued, let me provide some context to the investigation itself: • “Many of the charges brought forth are based on the word of a man who made a fortune by lying. The NCAA enforcement staff acknowledged to the University that if Nevin Shapiro, a convicted con man, said something more than once, it considered the allegation “corroborated” — an argument which is both ludicrous and counter to legal practice. • “Most of the sensationalized media accounts of Shapiro’s claims are found nowhere in the Notice of Allegations. Despite their efforts over two and a half years, the NCAA enforcement staff could not find evidence of prostitution, expensive cars for players, expensive dinners paid for by boosters, player bounty payments, rampant alcohol and drug use, or the alleged hundreds of thousands of dollars in cash and gifts given to student-athletes, as reported in the media. The fabricated story played well — the facts did not. The NCAA enforcement staff failed, even after repeated requests, to interview many essential witnesses of great integrity who could have provided first-hand testimony, including, unbelievably, Paul Dee, who has since passed away, but who served as Miami Athletic Director during many of the years that violations were alleged to have occurred. How could a supposedly thorough and fair investigation not even include the Director of Athletics? • “Finally, we believe the NCAA was responsible for damaging leaks of unsubstantiated allegations over the course of the investigation. “Let me be clear again: for any rule violation — substantiated and proven with facts — that the University, its employees, or student-athletes committed, we have been and should be held accountable. We have worked hard to improve our compliance oversight, and we have already self-imposed harsh sanctions. “We deeply regret any violations, but we have suffered enough. “The University and counsel will work diligently to prepare our official response to the Notice of Allegations and submit it to the Committee on Infractions within the required 90-day time period. “We trust that the Committee on Infractions will provide the fairness and integrity missing during the investigative process.” Read more here: www.miamiherald.com/2013/02/20...l#storylink=cpy

"The NCAA believes that former Miami assistant coaches Clint Hurtt, Aubrey Hill and Jorge Fernandez provided false or misleading information during the probe into the Hurricanes' athletic department.
The NCAA said all three violated "principles of ethical conduct" as part of the notice of allegations served against the Hurricanes, according to a person who spoke to The Associated Press on Wednesday on condition of anonymity because the allegations have not been released publicly."

Miami is the poster child for "lack of institutional control", and I have no doubts that tons of violations took place. But due to this mishandled investigation I think the Hurricanes are going to get off with a relative slap on the wrist.

Not really. It depends on what the Committee on Infractions decides to do with the charges.
Boise State, UCF, and Tennessee all recently got slapped with LOIC, and their programs are still standing. USC got hit with LOIC, and they were punished only slightly more than what UM has already self-imposed.

Just posted this over in ZZL, but I'll drop it here too:
From the Miami boards, it looks like Frank Haith is getting off easy. He wasn't charged with Unethical Conduct, which is the killer that might lead to show-cause and his firing. He was charged with "Failure to Monitor" for not reporting thins quicker once he found out, but that's likely just a slap on the wrist.
As for some other nuggets that have leaked out so far:
--3 lower-level Assistant Coaches (2 football, 1 b-ball) WILL be charged with Unethical Conduct for misleading the investigation.
--No top-level coaches or administrators other than Haith were charged with anything, and his charges were much more minor than expected.
--The charges against UM itself seem fairly minor compared to what was initially alleged. They claim that Shapiro bought Willis McGahee a suit to wear to the Heisman ceremony in '02, bought Vince Wilfork a used washer/dryer set, some dinners for other players, a couple pairs of sneakers and an engagement ring for an unnamed player to give to his girl. Also, he arranged for a girlfriend of his to set 2 UM players up with "no-show" jobs for a couple months.
--There was no mention of buying new cars, or of parties with hoes, drugs, abortions, etc. --There was also no mention of the supposed $10k payment that Shapiro claimed to have made to the family of basketball player DeQuan Jones; apparently they couldn't find any evidence of it, so dropped it from their list of allegations. This was the single most egregious of the original claims made by Shapiro involving the basketball team.

I'm no Miami fan but this entire investigation is tainted and should be tossed, much like a case is dismissed in court. There is probably no way to know what other types of "creative investigating" the NCAA engaged in and relying on Emmert or any of his cronies to bring it to light is like wishing upon a star.

The challenge, obviously, has been to separate what they have proof of versus what they don't. At this point in time, it looks like the stuff they have proof of is less substantial than much of the stuff that they don't have proof of.

They had LOIC and Failure to Monitor. They lost 4 TOTAL scholarships and 12 TOTAL official visits. If you study up for our future arguments with their fanbase, you will notice the words tutor and impermissable benefits noted as separate violations but not the word agent. Perhaps, but doubtful. Much of what was tossed was from the mouth of one guy--Sean Allen, an equipment guy with the football team and friend/associate of Shapiro's. In his testimony at the bankruptcy trial, he basically said he didn't know anything about the cars/drugs or the alleged payment to DeQuan Jones. He claimed that he did know about other small-time things and acted as middle-man on a couple different occasions between Shapiro and coaches. So...it looks like many of the more tawdry allegations were half-truths at best.

Don't know that the investigator demanded the phone as much as saw it sitting there and asked for it. Our brilliant, and my god hopefully no longer employed by UNC, lawyer told Quinn to sure give him the phone. Quinn should have sued him and UNC for that inept legal advice.

According to one leak a booster gave over $170,000 in improper benefits to players,recruits,and coaches. Also, he steered at least two players to a sports agency in which he had an interest.
Miami needs to release the report.

They are going to get hit harder than us, Ohio State and USC IMO. They'll get another bowl ban and more scholarships taken away than we had. Our story was befuddled with small violations by a few players and a supposed cheating scandal. Their story involves coaches and administration that had to know something was up. Plus, it involves multiple sports. I hate the NCAA but know how they operate. Miami is not in the SEC, so expect for them to get hit hard.

They've already been hit harder than UNC and Ohio State. They've served 2 bowl bans and sacrificed 5-6 schollies this past recruiting class.
USC got 2 bowl bans and fairly hefty schollie losses, not only because of their infractions (including the direct involvement of agents and about 350k in benefits to a couple players), but also because of their constant attempts to obfuscate and their lack of cooperation.
UM may get a few more schollie reductions (10-15 over 2-3 years), which would put them on par with USC's penalty. I can't see the NCAA meting out anything more than that, based on how they've screwed up this case. IMO, they'll want to sweep it under the rug. They'll do so on their own terms, though--which means they'll save a little face by sticking to the standard procedures of sending this thing to the Committee on Infractions and will still hold a formal hearing. But ultimately they'll praise UM for their cooperation and their willingness to impose what are the harshest penalties that any school has every placed upon itself, and will let UM off with a slap on the wrist (meaning no more bowl bans).
