Well I am sure glad we traded Parys Haralson and Cam Johnson 


49ers OLB Aldon Smith and Titans TE Delanie Walker were named in a Tuesday lawsuit that claims the two "illegally fired weapons on numerous occasions" during a June 2012 house party.

Ronndale Esporlas filed the lawsuit in Santa Clara (CA) County. Esporlas was shot at the party which was hosted at Smith's house. Both players reportedly began to fire multiple shots into the air while standing on a balcony in an effort to get party-goers to leave. Walker then allegedly made his way to the driveway and fired more shots into the air and toward party attendees. If you remember correctly, this is the same party Smith was stabbed at after trying to break up a fight. Who knows if anything more will come of this.

And I am still shocked as to why we kept Stupar, Ventrone and Jerod-Eddie over Cam Johnson. 

I just hope Cam doesn't go for 8-10 sacks. That 7th rounder wont look so good anymore.

The best part of the article: "consumed large amounts of alcohol and were brandishing and firing guns in the air.."  I hope this is just a guy looking for a payoff.

Nothing mixes better than copious amounts alcohol and loaded firearms.  Brilliant.   Seriously, how dumb are you? " Uhhh, we need to break up this party.  Ok.  Let's get our illegally-possessed firearms and shoot them in the air with all these people around, that'll get 'em to leave...or seriously injure or kill them." C'mon man.  Really?

Man I really hope this is untrue and just blown out of proportion because it sounds idiotic.

Aldon Smith does not seem like the brightest of men out there. The team should be careful before they give him big time money.

Hope Aldon can clear this without the loss of playing time.  I didn't like when we let Cam Johnson go (And said so) to start with.  It may only have been potential, and pre-season, but he looked like he had serious pass rushing skills and you can NEVER have to many good pass rushers on the team.

I agree...with Cam & Corey, we could've had that "next generation" of good young pass-rushers, if we weren't able to re-sign Aldon and/or we decided to let Brooks go at some point in the future to free up cap space.

To be clear here.  Possessing a firearm is not illegal.  In fact, you can legally carry your firearm on your belt and walk down the street as long as its publicly able to be viewed.  Now where they crossed into illegal, is when they discharged a fire arm within 50 yards? (possible 100 yards) of a dwelling or home.  I believe that it might fall under Discharging a firearm in a grossly negligent manner (246.3 PC), but I'm not a lawyer so I could be off on that.

Anyway.  Not illegal to own a gun.  That is all.biggrin

I wouldn't mind letting Smith walk next year. The personal issues along with how his on the field production evaporated last year tell me that he benefits more from the scheme and playing next to Justin Smith than pure football talent. I'd rather keep Iupati and lock up CK.

Oh, come on now.  First, this is a total shake down.  We're more than 12 months (I actually thought it was January) past and he played the entire season after the event.  Further, this is the one where he was stabbed and NFL presumably knew about it (unless Aldon was stupid enough not to tell the whole truth).  Does anyone really think this is other than about money?

Second, Cam was a rookie, who had one good game.  Look, I like him.  I was glad he made the squad. But Lemonier did more with no PS training than Cam did.  We'll be fine.  It just means next year we need to find soemone else.  Even if Aldon is not a long term answer, we still have Brooks and now Lemonier.  Back ups, the guy replacing Brooks, etc., will be easy enough to find given how many draft picks we have in the first three rounds next year.

Third, don't forget Skuta.  Yeah, maybe he's unheralded, but I also think our brass likes him ALOT.  So much so they didn't want to move him BACK to ILB early on (when our depth was questionable), and in the process saying he was much better suited to OLB.  If Cam was all that good, he'd have beaten him out.  Skuta isn't that old either (IIRC).  So, even with Smith not being a long term answer, we have Brooks, Skuta and Lemonier and Skuta is no worse than a quality back up.  Again, that basically means we use our higher picks to find the next Smith/Brooks to pair with Lemonier.  I trust the FO to get there.

The other 3 guys OP mentioned were not the threat to Cam.  Stupar, btw, was on our PS last year too, so I'm very glad he's made the team.  Stated differently, we were (least some of us), worried about depth at BOTH ILB and OLB and now we have three young pups at ILB who are "the next generation".  So, worst case (and I do mean worst), we have the need to find one guy to pair with Lemonier down the road, having filled the other three (with Lemonier, Stupar and Moody).

The article said "illegally possessed."  California is an 'open-carry' state. I know there are magazine capacity restrictions in CA.. If he has non-California compliant magazines (hi capacity) for a Glock, XD, or the like, then that would probably be what they were considering illegal. There are many CA gun laws, maybe he wasn't aware of the one he was violating. Although I would think not discharging one in your house unless you live on a ranch in Idaho would be common sense. Whatever the case, if you are firing bullets up in the air while trying to clear out a party in a suburban area of California you are lacking common sense and maybe depriving a village somewhere of an idiot.  Hope this is just over blown.

Just to be clear here, the complaint alleges that Walker and Smith knew the guns were illegally possessed; the reason it is alleged is because it's the plaintiff who is alleging they knew.

I won't go so far as aweissberg and assume this is a 'shake down,' but this is a suit brought up over an incident that happened over a year ago (i.e., not a new incident, but, in fact, the same incident in which Aldon Smith was stabbed and gun shots were reported to have been fired). The case was reported well within the statute of limitations, and, while one would expect a case to be filed much sooner after the event took place, I don't necessarily see anything here in the timing that suggests it was malicious. That doesn't mean there's much of a case, though, and that's what we'll need to wait to find out.

Definitely not something you want to have distracting the team or the players, but, until more facts are available, hard to make a judgment call on what this really will mean for Aldon. All I'll say is, I'm glad this is not, in fact, a new incident. If he is acquitted of any serious charges and if he continues to avoid issues and behave as a professional should behave, as he did through last year, I'm not going to continue to hold his prior idiocy/immaturity against him.

This past summer just seems like the NFL took a collective hard hit although I can't give any examples other than the obvious one.

Regarding Aldon Smith, I believe he is under contract through 2014 along with CK.  So if the Niners let Aldon Smith go via trade after this season, the compensation should be at minimum a 1st round pick depending on the team (draft position.)

Point or question being: Does talent out weigh the off field issues, depending on the issues?  There is no verdict yet so this could be a moot question.  I guess a civil suit is better than a criminal suit?

Well Smith sure has started this season off right. Had 3 sacks in today's game vs the Pack, along with all kinds of near sacks that kept Rogers on his toes. I would say the 49ers will do everything in their power to sign him long term, along with CK.

I thought Aldon Smith had two sacks, but it appears he was only credited with 1.5 sacks. Ray McDonald got credit for the other half sack. I'm assuming that was the second sack, where Aldon got a hand on Rodgers and Rodgers couldn't stay on his feet and McDonald fell on him as he went down.

Still, an excellent start to the season for Aldon Smith. He also had a few other hurries, to my observation (unfortunately, some led to positive-gain scrambles for Rodgers) and a couple of nice run stops.

I counted that last play a sack, even though the league probably won't give it to him. He got Rogers from behind on the very last play and Rogers basically just throw it 5 yards for an incomplete, but Rogers should have been ruled in the grass since AS had a hold of him for a good 3 seconds before Rogers gave up.

Yeah, the ruling was that he got the pass away, so he won't get a sack, but regardless, it was as impactful as a sack...I loved that Rodgers didn't even get a chance to throw it deep. You never know what might happen, whether a crazy catch or a pass interference. Taking that chance away was very nice.

it's funny because people were talking about how Aldon didn't have a single sack the last 6-7 games including the postseason, but what they never mentioned was the fact that for the rest of the regular season, we lost Justin Smith.

and in reality, Smith played with 1 arm in the postseason.

he's back and healthy, and now Aldon has 1 1/2 sacks to start the year.

if our D can stay healthy, Aldon SHOULD break the all-time sack record and erase the embarrassment of the Favre "ok you got me" sack he allowed by Strahan.

I think you are discounting the fact that he plays next to one of the best DL of all time. When they moved Aldon to the other side of the formation during the GB game, he didn't fare as well. I still contend that he is a product of the system.
