Re: State of PA to sue NCAA

I hope Penn State brings down the SEC controlled NCAA. All Ohio State fans should be rooting for Penn State in this case.

The NCAA is as corrupt as Penn State was.

Re: State of PA to sue NCAA

They'll likely win, the NCAA vastly overstepped its charter with the sanctions. They broke their own bylaws as well during this process. Simply put the NCAA was way too inconsistent with sanctions, had no legal ground to impose the level of sanctions imposed for a criminal matter.

From our perspective, it's a no lose situation.  If it reopens the investigation and makes PSU and the Paternophiles look worse, it's worth it.  If the NCAA is proven to have been unjust, Ohio St. and USC will certainly be applauding.

Oh so now the NCAA is going to investigate non-profits? This keeps getting better.

Still delusional.  Why should they be able to dictate where the NCAA donates that money?

They don't have to pay $60 million to the NCAA. Membership in the NCAA is voluntary. If they don't want to pay it, then PSU should just quit the NCAA....problem solved.

This.  I've sometimes questioned the NCAA's jurisdication on sanctioning PSU concerning this heinous criminal act without the "this is taking forever" NCAA investigation and follow-up hearing.  Don't get me wrong, they should hang JS by his balls and I agree with what PSU did removing the JoePa statue, etc. but that is really a separate matter.  This is all about the NCAA not following their own due process through their Committee on Infractions.  Swift justice may not have been the correct approach and my concern is this may have created a precedence on how the NCAA conducts it's business in the future.

Makes sense to me the sanctions have major impact and 60 million is a lot of money whether they try to get it back or control where it goes for charity. We would do the same, we should not throw stones at glass houses.

What due process? The NCAA is a private organization. In addition, PSU accepted the punishment. This is just about the money and political grandstanding as the time to contest the sanctions has come and gone. It is doubtful that the state has any standing in this manner.

This.   Tom Corbett is a S.O.B. who was a veteran AG and he doesn't play patty cake.  NCAA is going to get crushed and at the minimum the sanctions are going to be SEVERELY diminished.  Take that to the bank and cash it.

Emmert is wetting his pants tonight I can assure you.

That's why it's being filed as an Anti-Trust suit.  There are no other outlets and NCAA is using that fact to shakedown schools for profit.

If you don't think the state is going to win this, (either in court, or in a big settlement victory), you're in for a big surprise.

They won't. The NCAA is a members only club. You abide by their rules or get out. There are other outlets like the NAIA just cause they make less money doesn't mean jack.

OK, kids.  Maybe wait to see the lawsuit before we decide who is going to win?

Or, if you insist on playing lawyer in the dark, then tell me why the University's acceptance of the sanctions doesn't cause you any concern.
