Say goodbye to the name "Redskins" 


The United States Patent and Trademark Office has canceled the Washington Redskins trademark registration, calling the football team’s name “disparaging to Native Americans.”

Still don't understand why the Washington NFL honchos won't change the name of their team to the "Washington Oneidas."  The name of this Native American tribe sounds a heckua lot better than the staid 'ol "Redskins" ... 

And the Native American community would support it.

I've found it interesting throughout this debate how many people (White and Black) have very vocal opinions on whether or not someone who is a Native American should be offended by the name.

If you'e not part of a particular group, I really don't think your opinion has much weight. It's sort of like someone from Greenland arguing over whether someone Polish should be offended by a team called "the Pollacks".

You really think the PC police will stop at the Redskins???!!!

If I were Dan Snyder...I'd really flip the finger at the City of Washington and rename the team in a real insulting way...like Washington RedTAPE.  Or Washington Dictators.  Washington Looters.  Or Washington Shredders (shred the Constitution).  Or simply drop Washington from the name and go with Redskins.

So, what does this ruling really mean legally?  That I or anyone else can go out and produce/sell Washington Redskins merchandise and there's nothing the NFL or the Redskins franchise can do about it since they don't own the trademark?

A few thoughts.

1) The Seminole Tribe is on record as supporting the team name.
2) The Braves *might* be in trouble, but there's a distinction. "Braves" is a profession, a warrior class/occupation within a racial or tribal society of Native American origin. Might still apply, but somewhat different. Not dissimilar to "Vikings" being a warrior/pirate class/occupation within Norse society.
3) Cleveland Indians are likely somewhere in between. To me they may also be on shaky ground.
4) Golden State Warriors - completely in the clear.

Again, opinions vary and I'm not claiming mine is a perfect viewpoint. I could create team names that could be viewed as disparaging by other affected groups (for example a KKK themed team - which is an "occupation/class"). 

But the bottom line is, naming teams after groups that have historically been oppressed - especially without their consent - is risky.
